There are several ways to register your protest to this unfair
and unlawful TAX on manufacturers. First and foremost, DO NOT REGISTER OR
PAY ANY FEES TO THE ESA. You are under no legal obligation to do so until the
Ontario Government amends O.R. 438/07 changing the deemed approvals clause in section 2.
We are petitioning the government NOT to change O.R. 428/07 as we believe the existing
regulation making product certification through a CB mandatory will continually improve
product safety regardless of any actions by the ESA. We will continually petition the
Ontario Government until they assure us the ESA registration fee scheme will be withdrawn,
or they do indeed amend O.R 438/07. If the governemnt amends O.R. 438/07, we
will continue to petition for the amendment to be withdrawn by other public means.
If you are a CANADIAN Electrical/Electronics manufacturer
At Present, you can help by sending a letter/email to the
Ministry of Small Business and Consumer Services expressing your concerns about the ESA
scheme and that O.R. 438/07 should not be amended to give the ESA powers of direct
taxation on your business.

There is no need to send a letter of protest to the ESA as they
will simply send a form letter back to you and the Minister ( or us ) will likely never
know of your protest.

manufacturer
If you did receive a copy of the letter from the ESA via your CB,
the US Department of Commerce-International Trade Association would like to hear from you
as they will be pursuing this matter through diplomatic efforts and a possible NAFTA
appeal. They have asked us not to put their contact information of the website and instead
ask that you simply send an email to esaprotest@ontrak.net
requesting the contact information or call Valerie at ( 705 ) 671 -2652 to register and
receive the contact information.
The procedure to register is simply a telephone call where the US
DOC official will ask you a few questions about your company and thats it. You may
have to leave a message and if so, we have been told by a few US contacts that they
callback in a about a week.
